Community advocacy organizations Neighbors for a Better Micron and Jobs to Move America filed an Article 78 petition in Albany County Supreme Court aiming to void two environmental permits issued for Micron $100 billion semiconductor campus in Clay, New York. The lawsuit alleges that state regulatory agencies approved wastewater and air permits that fail to prevent dangerous PFAS forever chemicals from entering the Oneida River watershed.

The legal action further targets Micron Title V air permit, noting that state regulators previously acknowledged the facility greenhouse gas emissions would conflict with New York statutory climate goals before granting approvals based on national security considerations. Despite ongoing litigation, construction on the 1,400 acre campus commenced in January, with initial concrete poured in July 2026. Designed to eventually house four distinct fabrication units, the site is projected to generate 9,000 direct positions and over 40,000 supply chain jobs, with initial semiconductor manufacturing scheduled to begin in 2030.
