Mexican influencer’s encounter with ICE ended in gunfire and a $50 million legal claim

-
ICE operation procedures led Mexican influencer Carlitos Ricardo Parias to file a massive $50M legal claim against the federal government following an arrest incident in South Los Angeles.
-
Federal authorities charged Parias with ramming police vehicles, but a federal judge dismissed the entire case over constitutional violations.
-
Immigration attorneys demand the immediate release of the content creator, who remains in federal custody despite having no active criminal charges.
Content creator Carlitos Ricardo Parias, widely known on TikTok as ‘Richard LA’ for reporting on local safety and immigration raids in the South Central area of Los Angeles, filed a $50M lawsuit against President Donald Trump’s administration after sustaining a gunshot wound during an arrest in October 2025, alleging that authorities violated his constitutional rights.
In addition, U.S. Marshals and agents conducting a specific ICE operation intercepted the 45 year old Latino reporter while he was covering a community event, triggering a shootout in which a bullet struck him in the elbow and ricocheted off an agent’s hand while legal advocates hold agents responsible for excessive use of force.

Key factors behind the arrest of Mexican influencer
-
ICE operation enforcement tactics in Los Angeles became a central focal point after Mexican influencer gained massive popularity on TikTok by sharing daily Spanish language reports about safety incidents, buying bread and immigration raids in Latino neighborhoods across California.
-
The Department of Justice initially accused the activist of ramming police vehicles and assaulting federal officers during the law enforcement response.
-
A federal judge dismissed the criminal charges after determining that investigators deprived the defendant of his fundamental right to legal counsel.
As a result, following the dismissal of the criminal case, defense attorneys submitted the administrative claim on Tuesday October 22 as a necessary first step toward filing a major lawsuit against the government.
Last October, popular LA TikToker Carlitos Ricardo Parias (known as Richard LA) was shot by ICE agents and detained. His family and @RepKamlagerDove, who has visited him in Adelanto detention, say he is being medically neglected and is in danger of losing his arm.
Spectrum News reviewed his medical records from his time in ICE detention, which include recommendations of physical therapy that was never conducted. They report that Parias’ pain is so acute, simple touch to his injured arm brings tears to his eyes.
While he has no criminal record, Parias did arrive to the U.S. illegally in 2002 from Mexico.
ICE and DHS did not respond to our inquiry as to why the medical advice for Parias was not followed, or to Kamlager-Dove’s claims of medical neglect. But just hours before a press conference the congresswoman was set to give to shed light on Parias’ plight, ICE called to tell his family that Parias could be moved to Otay Mesa for better medical care. But his family worries that could mean an expedited deportation. “They have been telling us all these months – since October – that they’ve been giving him the proper medical care. So what has changed?”

Continuous detention and government appeal
On the other hand, federal prosecutors under the Trump administration filed an appeal to overturn the judicial ruling favoring the digital reporter, seeking to maintain the legal validity of actions taken during the armed intervention.
Furthermore, defense representatives demand the immediate release of the popular communicator while labeling his current detention entirely unlawful, pointing out that local ICE operation tactics in Los Angeles served as testing grounds for nationwide raids while targeting independent community activists who documented enforcement activity in real time.
Meanwhile, immigration attorney Carlos Jurado told news outlets like ABC News that “He should not be detained… all criminal charges brought against him have been dismissed”, emphasizing that prolonged custody lacks legal standing and building a firm basis for full court proceedings.
Community support and defense of local reporting after ICE operation
However, the local Latino community in South Central Los Angeles continues to support the digital reporter, acknowledging that his broadcasts provided vital warnings regarding safety for working families across the area during every ICE operation.
Looking ahead, as the government appeal moves through the court system, defenders of Mexican influencer maintain their financial claim while demanding an immediate end to rights violations against community reporters nationwide, ensuring that legal fallout from this violent ICE operation establishes a critical precedent for Latino residents.
